In the absence of any statement to the contrary below, H. Östberg AB (hereinafter referred to as “we”, “us”) is the common Controller for the processing of your personal data according to this notification.
Our objective is for you to feel secure when providing us with personal data. We apply technical and organisational measures to protect your personal data and to ensure that processing is performed in accordance with the applicable data protection legislation, as well as our internal guidelines, policies and procedures for processing personal data.

We offer services to our users, through our:

• Website support.ostberg.com (the “Support Center”)
• HERU IQ mobile application (the “HERU IQ app”)

Services listed above are collectively referred to as the “Services”.

Which personal data do we process, why and for how long?

We process data such as names, addresses and contact details so as to be able to fulfil agreements with our customers and suppliers. We store your personal data for as long as a customer or supplier relationship remains in effect.

From which sources do we collect personal data?

We collect information about your name, address and contact details directly from you or from register a user in the HERU IQ app.

Location Data

We collect precise or approximate location data from a user’s mobile device if enabled by the user to do so. HERU IQ app collects this data when the HERU IQ app is running in the foreground (app open and on-screen) or background (app open but not on-screen) of their mobile device. Users may use the HERU IQ app without enabling it to collect location data from their mobile devices, but this will affect some functionality available in the HERU IQ app. HERU IQ app uses the location data to be enabled in order to maintain stable connection with nearby IoT devices. This only applies when HERU IQ app is running on Android version 11 and lower.

With whom do we share data?

In order to fulfil the purpose of our processing of your personal data as stated above, we commission other service providers who process personal data on our instructions. These service providers may only process your personal data in accordance with the applicable legislation. They are responsible for adopting suitable technical and organisational security measures to protect your data.
Where appropriate, we may disclose your personal data to recipients other than those mentioned above, in order to abide by applicable laws and regulations, in response to a request or an order from an authorised court or authority, and in order to safeguard our legitimate interest in establishing, exercising and defending legal claims.

Your rights

Under the applicable data protection legislation, you have the following rights:

Register extract

You have the right to request, once a year and free of charge, confirmation from us that we are processing personal data that apply to you and, this being the case, to request access to the personal information we are processing about you – known as a “register extract”.

Request rectification

In addition, if you consider information about you to be incorrect or incomplete, you have the right to request rectification.

Right to object to processing for the purposes of direct marketing

You also have the right to contact us at any time to object to our processing of your data to inform you about H. Östberg AB’s products, and to unsubscribe from continued mailshots.
As from 25 May 2018, you also have the following rights, over and above those listed above, and to the extent stipulated in the applicable data protection legislation.

The right to object to processing based on a balancing of interests.

You have the right to object to any processing based on a balancing of interests. However, we may continue to process your data – even though you have objected to the processing – if we have a compelling, legitimate reason for the processing that outweighs the interest of your privacy.

Right to request restriction of processing

You also have the right, where stipulated by the applicable data protection legislation, to request restriction of the processing of your personal data. Please note, however, that if you request restriction of the processing of your personal data, this may result in our being unable to fulfil our obligations to you and/or your company during the period the processing is restricted.
